Our summer contest for the most beautiful photo of the Danubiana Meulensteen Art Museum has begun. Take a beautiful photo of Danubiana, send it to us by e-mail at danubiana
danubiana [dot] sk, indicating the author's name and the photo title, and we will publish it on our Facebook page. The photograph that has the most "likes" by October 7th will be the winner and the photographer will be awarded an unframed lithograph of his/her choice. General conditions:
I. Contest Organizer
The Take a Photography and Win a Lithography Contest (hereinafter referred to as the “Contest”) is organized by the non-profit organization, DANUBIANA – Centrum moderného umenia, n. o., with its registered seat at Nám. Martina Benku 6, 811 07 Bratislava, BIN 45 737 932 (hereinafter referred to as the “Organizer”).
The Organizer of the Contest has provided the prizes for this Contest.
II. Purpose of the Contest
Promotion of Danubiana Meulensteen Art Museum – the Museum of Modern Art.
III. Duration of the Contest
The Contest shall run from June 22 through September 30, 2015
IV. Terms and Conditions of the Contest
Anyone 18 years or older (hereinafter referred to as a “Contestant”), who, in the period from June 22 to midnight October 7th, 2015 submits to the Organizer a photograph via e-mail to the address: danubianadanubiana [dot] sk, may participate in this Contest. Contestants are also required to indicate their first name, surname, address and telephone number in the text of e-mail.
V. Terms and Conditions for Submitting a Photograph for the Contest
Every Contestant must comply with the following terms and conditions in order to be eligible to enter the Contest:
a) the photograph must depict the building of Danubiana Meulensteen Art Museum - the Museum of Modern Art or a part thereof;
b) the photograph must be taken during the course of the Contest;
c) the photograph may not come from commercial databases or other publicly accessible sources,
d) the Contestant must be the photographer of the photograph or must have the authorization to use the photograph for the purpose of participating in this Contest and to grant his/her consent to its further use by the Organizer in compliance with the terms and conditions of this Contest; and
e) the Contestant may only submit one photograph, but in the event that he/she submits several photographs, the first delivered photograph shall be considered as the Contest entry, and in the event that several photographs are delivered at once, the Contest entry shall be selected by the Organizer.
The Organizer reserves the right to appropriately examine the Contestants’ compliance with the aforementioned terms and conditions, and in the event that it is proven during the course of the Contest that a photograph fails to comply with the terms and conditions of the Contest, the Organizer reserves the right to disqualify the relevant Contestant from the Contest; or if the violation of the terms and conditions of the Contest is revealed after the Prize has been awarded, the Organizer reserves the right to seek the return of the Prize.
The Organizer is authorized to publicize on its Facebook profile (https://www.facebook.com/danubianamuseum) all photographs which are judged to have successfully passed the preliminary examination of compliance with the terms and conditions of the Contest.
VI. Selecting the Winner of the Contest
The photograph publicized on https://www.facebook.com/danubianamuseum which receives the most votes or “likes” from visitors to the Organizer’s profile by the end of the Contest shall be the winner.
In the event that two or more photographs receive the same number of votes, the earliest submitted photograph to the Contest shall be the winner.
VII. – Prize
Upon the conclusion of the Contest, the Organizer shall publicize the name of the winner of the Contest on its Facebook profile and inform the winner directly via the e-mail address and telephone number listed in the text of his/her e-mail submission. Within 10 days of his/her notification, the winner of the Contest is required to pick up one of the following prizes:

In the event that the winner fails to pick up his/her prize within the aforementioned dates pursuant to this point of the terms and conditions of this Contest or if the winner fails to provide his/her contact data in his/her email, his/her entitlement to the prize shall cease. The Organizer shall then be authorized to select as the winner the Contestant who received the second highest number of votes or the next Contestant if the entitlement to the prize also ceased for the second Contestant or the next Contestant until a winner is finally selected.
VIII. Presentation of the Prize
The prize shall be presented to the winner in person at the Danubiana Meulensteen Art Museum - the Museum of Modern Art on the date designated by the Organizer or on a date agreed upon between the Organizer and the winner.
The winner of the Contest shall be obliged to present his/her personal data to the Organizer in order to verify his/her identity. If the winner refuses to provide his/her personal data such as first name, surname, permanent residence, his/her entitlement to the prize shall cease. Upon the request of the Organizer, the winner of the Contest shall also be obliged to demonstrate to the satisfaction of the Organizer that he/she was the photographer of the winning photograph or that he/she has the authorization to handle the photograph in order to ensure that the terms and conditions of the Contest, including the rights of the Organizer for its further use, are not violated. In the event that the winner fails to demonstrate that he/she was the photographer of the winning photograph or that he/she has the authorization to handle the photograph pursuant to the previous sentence, his/her entitlement to the prize shall cease.
In the event that the winner fails to express his/her agreement to accept the prize, forfeits the prize or fails to comply with other terms and conditions indicated in the Terms and Conditions of the Contest, his/her entitlement to the prize shall cease and the Organizer shall be entitled to proceed in compliance with Article VII until the valid presentation of the prize.
IX. Rights and Obligations of the Contestant
By entering the Contest and sending the photograph, the Contestant agrees with the terms and conditions of the Contest, particularly with the publicizing of the photograph on the Organizer’s Facebook profile and website http://www.danubiana.sk, as well as any use for promotional, marketing and advertising purposes by the Organizer or its contractual partner. The Contestant agrees with the use of his/her photograph pursuant to the previous sentence without any entitlement to any remuneration for such use.
The Contestant who wins the Contest shall grant the Organizer a free of charge, exclusive, material, punctual and territorially unlimited license for the use, dissemination, copying, accessing and/or processing of the contest photograph in any way (including any manner and form) and for any purposes according to discretion of the Organizer.
The Contestant who wins the Contest undertakes to allow the free of charge taking of photographs and audio-visual recording of the award ceremony, and he/she also agrees with the free of charge use of such recording and photograph of his/her receiving the prize for the promotional, marketing and advertising purposes of the Organizer or its contractual partner.
The Contestant who wins the Contest agrees with the publicizing of his/her name and surname as the winner of the Contest on the Organizer’s Facebook profile and website http://www.danubiana.sk, as well as with the inclusion of his/her name on any of its promotional, marketing and advertising items.
By entering the Contest and sending the photograph to the Organizer, the Contestant expresses his/her consent to the terms and conditions of this Contest and undertakes to adhere to them.
The Contestant agrees to allow the Organizer or a third person authorized by the Organizer to process manually and via computer his/her personal data indicated in the email, in particular, in the following extent: first name, surname, address, e-mail, telephone number (hereinafter referred to as the “consent to process data”). The Contestant hereby declares that he/she is aware of his/her rights pursuant to Article 28 of Act No. 122/2013 Coll. on Personal Data Protection and on amendments and supplements to certain Acts (hereinafter referred to as the “Act on Personal Data Protection”) particularly the right to request information from the Organizer regarding personal data processing, the list of personal data which are subject to processing, a certificate about whether his/her data has been processed, information about the source from which the Organizer obtained his/her personal data, the right to require a correction of incorrect personal data and the right to withdraw his/her consent to process his/her personal data, namely in writing at the address of the Organizer. The Organizer is authorized to publicize the name and surname of the Contestant on the Contest website and in mass media promotional materials.
A Contestant has the right to withdraw his/her consent to personal data processing at anytime in writing in the form of a notification addressed to the Organizer. A Contestant who withdraws his/her consent during the Contest or after the announcement of the winner shall lose his/her status as a Contestant and thus also his/her entitlement to the prize. A Contestant may terminate his/her participation in the Contest at anytime, namely by sending a written notification to the address of the seat of the Organizer or via an e-mail notification sent to danubianadanubiana [dot] sk. The Organizer shall immediately delete the personal data of any Contestant who withdraws his/her consent or whose participation in the Contest has ceased pursuant to the terms and conditions of this Contest.
The Contestant shall be liable for any damages incurred by the Organizer due a to a copyright violation related to the Contest photograph by the Contestant, for example, if the Organizer publicizes on its Facebook profile a Contest photograph sent by the Contestant that was not photographed by the Contestant and the original photographer of the photograph claims compensation upon the publicizing of the photography due to a breach of his/her copyright.
VIII. – Final Provisions
The Contest is organized as a promotional contest pursuant to Article 3, paragraph 5 of Act No. 171/2005 Coll. on Gambling Games and on amendments and supplements to certain Acts. The prizes in this Contest may be subject to taxation pursuant to the relevant provisions of Act No. 595/2003 Coll. on Income Tax as amended. The Contestant shall be exclusively responsible for the discharge of any tax duty arising to him/her in connection with the prize. The Organizer has no liability for the Contestant’s failure to discharge his/her possible tax duty.
The Organizer of the Contest reserves the right to change the rules at anytime based on serious reasons, and to extend, shorten, delay, suspend or terminate the Contest without compensation. Any possible changes to the rules of the Contest shall be appropriately publicized on the website http://www.danubiana.sk/sk and shall enter into validity and effect on the date of establishment of the amended Terms and Conditions of the Contest.
The results of the Contest shall be final without any possibility to appeal. The Contestants hereby acknowledge that they may not request a prize of a higher value or number than the prize established by the Organizer and that they may not request a cash payment in lieu of the prize.
A written copy of these Terms and Conditions of the Contest has been deposited with the Organizer of the Contest. Anyone who can prove a legal interest is entitled to examine these Terms and Conditions of the Contest deposited with the Organizer. These Terms and Conditions of the Contest shall enter into validity on the day of its signing by the authorized representative of the Organizer.
